For any of you paying attention to this blog. We reported that WindowsXP.com had expired and was in the middle of an auction at NameJet. The domain was pulled today from the auction (despite being having only one day remaining). Although I’m not entirely surprised due to the Blatant TM infringement, I did request clarification on why. I recieved this response:
” The Domain was removed from auction Per the NameJet Agreement, Section 3.4, listed below.
NameJet Agreement, Section 3.4 in part:
You also agree that NameJet shall have the right in its sole discretion to suspend or cancel any auction (Public or Private) prior to commencement of, during, or after completion of, the auction.
While this seldom happens, a rare set of circumstances may necessitate a domain auction to close early or be removed from your account. This could be for a copyright violation, trademark infringement or other legal situation for example. If a domain is removed from your account, you will receive full credit for all auction fees paid for the domain. NameJet management takes this action very seriously and does not exercise this option lightly.”
Although I have no problem with this policy, what frustrates me is when its chosen to be enforced. Just yesterday the domain name Caddyshack.com was allowed to complete at auction without any kind of reprisal from NameJet. That domain itself has Trademarks all over it. Is it because Microsoft has the ability, know-how, and tenacity to fight back?

Today, MostWantedDomains.comĀ reported the sale of Sexe.org. A huge sales price of $151,400 makes this one of the highest non .com adult domain sales of all time. Sexe translates to Sex in French. Congrats to Michael of MostWantedDomains.com on this fantastic sale.

I want to tip my hat to NameJet, I know I have moaned about them in the past, but this time they did something right by me. I had entered into some auctions where I wasn’t the winning bidder. After I lose, I move on. Well, apparently it doesn’t work like that. When the winning bidder defaulted, the domains went back to auction weeks later, with me as the winning bidder without even realizing it.
I got dinged for 13 domain purchases that I did not want or need (as money had been allocated elsewhere). I didn’t realize at the time what was going on and submitted a ticket with my complaint.
I was surprised to hear this morning that they would refund the domain names that were “won” in this manner as a one time courtesy.
Again, I thank Elisha. It was a slow process via ticket, but it appears she got the job done.

People involved in the domain industry can go by many names. Domain Investors, Domain Managers, Web Asset Managers (mine) and of course Domainers. Today the domain, DomainersForum.com closed on NameJet for a cool price of $3,300. Does this sale signify and acknowledge “Domainer” is the preferred description of our occupation? It just may.

Caddyshack.com will close at NameJet today, currently at $1,800 with a few hours remaining. The Domain was registered back in 1996 and dropped just the other day as the original registrant failed to renew. This movie is a classic and voted one of the top funniest movies of all time. Once more the new owner will face some potential TM issues with several live trademarks on this name.

TotalCare.com closed at NameJet today at $16,101. A great domain name for a brand. Unfortunately, no Advertisers for the term which makes the acquisition price seem a bit high. All in all though, a quality domain name with plenty of other businesses with like names.

I know that with a new operating system out, and im sure another in the works, Windows XP is looking like a thing of the past - but quite a few computers still run thisĀ OS. So what has inspired Microsoft to allow WindowsXP.com to expire and make it ways to the NameJet auction platform? Perhaps it was an accident? Either way, someone will be the new owner of WindowsXP in just under 3 days time and possibly a UDRP to follow.

A domain name with massive advertising for its keyword, the name reached $20,200 on the drop market yesterday. Congrats to the new owner, this one may be a decent revenue producer if parked.

I will be heading out to Vegas on July 27th for a couple of events. I plan to meet up with Dutch Boyd, anyone familiar with the World Series of poker will probably recognize that name. We are planning on having a “domain” poker game while I’m out there - all are welcome.

Several weeks ago the domain name LH.com was lost via UDRP to Lufthansa. It changed hands on the whois information was updated accordingly. It is now being rumored that the domain name has since returned to its previous owner, FMA (Future Media Architects). The historical whois would back this possibility as it currently displays FMA as the registrant. Will update with more info as it becomes available.
